These Terms and Conditions govern your access to and use of the Dragon Phoenix Kung Fu and Tai Chi website, located at www.dragonphoenix.org, and any related webpages, forms, online content, registration links, or purchasing functions operated by Dragon Phoenix.
In these Terms, “Dragon Phoenix,” “we,” “us,” and “our” refer to Dragon Phoenix Kung Fu and Tai Chi. “You” and “your” refer to the person using the website or, when applicable, the parent, legal guardian, student, customer, renter, or organization making a purchase or registration.
By using the website, submitting a form, registering for a class, or completing a purchase through the website, you agree to these Terms and our Privacy Policy.
If you do not agree with these Terms, please do not use the website or submit information through it.
1. Purpose of the Website
The website provides information about Dragon Phoenix programs, including:
Kung fu, Tai Chi, Qigong, martial arts, dance, yoga, and related classes
Children’s and adult programs
Drop-in classes
Workshops, events, and performances
The Dragon Phoenix Online Academy

Information on the website is provided for general informational and transactional purposes. Program availability, schedules, instructors, prices, and other details may change.
2. Eligibility and Parental Responsibility
You must have the legal capacity to enter into an agreement to use transactional portions of the website.
Parents or legal guardians must complete registrations, purchases, waivers, and account creation for children who are not legally able to enter into those agreements themselves.
Children under age 13 should not independently submit personal information through the website. Information concerning a child should be provided by the child’s parent or legal guardian.
By registering a minor, you represent that you are the child’s parent or legal guardian or that you otherwise have legal authority to complete the registration.
3. Separate Program Agreements
These Terms govern use of the website. They do not replace agreements that apply to particular Dragon Phoenix activities.
Participation may require separate documents, including:
Membership agreements
Assumption-of-risk and liability waivers
Health or emergency-information forms
Media releases
Tournament or event agreements
Online Academy membership terms
Facility-rental agreements
Instructor, contractor, volunteer, or leadership agreements
Scholarship or tuition-assistance agreements
When a separate agreement conflicts with these general website Terms concerning that particular service, the more specific agreement controls.
4. Martial Arts and Physical-Activity Notice
Martial arts, fitness, dance, yoga, weapons training, sparring, partner exercises, and related activities involve physical exertion and may carry a risk of injury.
Information provided on the website, in articles, in videos, or through online instructional materials is educational and is not medical advice. You are responsible for determining whether an activity is appropriate for you or your child.
Consult an appropriate healthcare professional before beginning a physical program when health conditions, injuries, pregnancy, medications, physical limitations, or other concerns may affect safe participation.
Participation in an in-person or online activity may require acceptance of a separate waiver and assumption-of-risk agreement.
5. Class Information and Scheduling
We attempt to keep schedules, class descriptions, instructor information, prices, and availability accurate. Nevertheless:
Classes may be added, canceled, rescheduled, combined, or assigned to a different qualified instructor.
Programs may close when capacity is reached.
Weather, illness, emergencies, instructor availability, facility issues, or other circumstances may affect the schedule.
Eligibility requirements may apply based on age, experience, rank, readiness, safety, or instructor approval.
Submitting a form or requesting a class does not guarantee a reservation until confirmation is provided through Dragon Phoenix or its authorized registration system.
6. Trial Classes
A free trial class may be available for designated curriculum-based programs.
Trial availability, eligibility, and frequency may vary by program. Drop-in classes, workshops, special events, private lessons, and limited-capacity programs may require payment and may not include a free trial.
A trial registration is intended for prospective students who are genuinely considering the program. We may limit repeated trial bookings or cancel registrations that appear fraudulent, abusive, or inconsistent with the purpose of the offer.
Parents and guardians remain responsible for supervising their children before and after the scheduled class and for providing accurate emergency and contact information.
7. Memberships and Tuition
Membership prices, class frequency, introductory offers, discounts, and included benefits are displayed on the applicable program or registration page.
Unless a specific agreement states otherwise:
Membership fees are charged according to the selected plan.
Members are responsible for maintaining a valid payment method.
Failed or declined payments may interrupt access to classes or online resources.
Class eligibility and attendance are subject to the selected membership.
Tuition does not guarantee promotion, rank advancement, competition placement, certification, or a particular outcome.
Promotion depends on the applicable curriculum, readiness, conduct, technical development, attendance, and instructor evaluation.
Current cancellation and notice requirements will be stated during enrollment or in the applicable membership agreement.
8. Online Academy and Digital Content
Dragon Phoenix may provide online lessons, videos, livestreams, documents, course materials, community access, feedback, and other digital resources.
Unless expressly stated otherwise:
Access is for the enrolled student or authorized household only.
Account credentials may not be shared publicly or with unrelated individuals.
Course videos and materials may not be downloaded, copied, recorded, redistributed, resold, publicly displayed, or used to create competing instructional content.
Access may depend on an active membership or purchase.
Specific course availability may change as content is revised, replaced, or reorganized.
Internet access, a compatible device, and appropriate space for practice are the user’s responsibility.
Online instruction cannot provide the same supervision, physical correction, or environmental control as in-person training. Students are responsible for selecting an appropriate practice space, removing hazards, and staying within their physical abilities.
Parents or legal guardians must supervise minors participating in online training as reasonably appropriate for the child’s age and activity.
9. Purchases and Payment
Purchases may be processed through Squarespace, Gymdesk, Stripe, or another authorized payment provider.
By completing a purchase, you represent that:
The information you provide is accurate.
You are authorized to use the selected payment method.
You agree to pay the displayed price, taxes, shipping charges, and clearly disclosed fees.
You authorize the applicable payment provider to process the transaction.
Dragon Phoenix generally does not receive or store complete payment-card numbers.
Prices may change prospectively. A price change will not alter a completed purchase unless correction of an obvious error is legally permitted and communicated to you.
10. Cancellations, Refunds, and Credits
Cancellation, refund, transfer, rescheduling, and credit policies may differ among:
Monthly memberships
Beginner programs
Drop-in classes
Workshops and seminars
Private lessons
Camps
Tournaments
Merchandise
Digital products
Online Academy subscriptions
Facility rentals
The policy displayed during checkout, registration, or enrollment governs the applicable purchase.
Unless otherwise stated, failure to attend a reserved class or event does not automatically create a refund or account credit.
If Dragon Phoenix cancels a paid class or event, we may provide a refund, rescheduled date, replacement class, or account credit as appropriate to the circumstances and the applicable offer.
Nothing in these Terms limits rights that cannot lawfully be waived.
11. Recurring Payments
Certain memberships or subscriptions may renew automatically.
When automatic renewal applies, the registration or checkout process should disclose:
The amount or method used to determine the amount
The billing frequency
The cancellation method
Any applicable notice requirement
By selecting a recurring membership, you authorize charges according to the terms displayed during enrollment until the membership is canceled in accordance with the applicable agreement.
Deleting an email, ceasing attendance, or failing to use an online account does not necessarily cancel an active recurring membership. Cancellation must be submitted through the stated cancellation method.
12. Discounts, Referrals, and Promotional Offers
Discounts and promotional offers are subject to their stated conditions.
Unless specifically stated otherwise:
Discounts may not be combined.
Discounts have no cash value.
Referral rewards apply only after the referred student completes the required enrollment.
A referral reward may be limited to tuition of equal or lesser value.
Promotions may have eligibility dates, capacity limits, or program restrictions.
Dragon Phoenix may correct misuse, duplication, fraud, or administrative errors.
Scholarships and tuition assistance are subject to availability, eligibility, funding, and separate approval.
13. Facility Rentals
Facility rentals require approval and may require a separate written rental agreement, deposit, insurance documentation, and liability provisions.
Website descriptions or preliminary communications do not reserve the facility. A rental is confirmed only when Dragon Phoenix has approved the reservation and any required agreement and payment have been completed.
Renters are responsible for their guests, activities, equipment, cleanup, legal compliance, and any damage beyond ordinary wear.
14. Merchandise and Physical Products
Product descriptions, photographs, sizes, materials, and availability are provided as accurately as reasonably possible. Appearance may vary because of screen settings, manufacturing differences, or product revisions.
We may limit quantities, discontinue products, correct errors, or cancel an order when an item is unavailable. If we cancel a paid order, the amount paid for the canceled item will be refunded.
Shipping timeframes are estimates unless expressly guaranteed.
Return and exchange eligibility will be stated at checkout or communicated for the applicable product. Custom, personalized, worn, washed, used, digital, or clearance items may be nonreturnable when disclosed before purchase.
15. Intellectual Property
Unless otherwise indicated, the website and its original content are owned by or licensed to Dragon Phoenix and are protected by applicable intellectual-property laws.

16. User-Submitted Content

You retain ownership of your original content.
When you expressly authorize Dragon Phoenix to publish submitted material, you grant Dragon Phoenix a nonexclusive, royalty-free license to use, reproduce, edit for length or formatting, display, and distribute that material for the authorized purpose.
This permission does not override a separate media release or testimonial agreement.
You represent that:
You have the right to submit the material.
The material is accurate to the best of your knowledge.
Its use will not violate another person’s rights.
You have obtained appropriate permission for identifiable minors or third parties.
You may request that we stop using voluntarily submitted promotional content in future materials. Removal may not be possible from materials already printed, distributed, archived, or incorporated into completed projects.

When you affirmatively accept an agreement electronically, your electronic acceptance may have the same effect as a handwritten signature to the extent permitted by applicable law.
You are responsible for maintaining a current email address and telephone number for account-related communications.
Marketing communications remain subject to applicable consent and opt-out requirements described in the Privacy Policy.
21. Website Availability and Corrections
We work to keep the website functioning and its information current, but we do not guarantee uninterrupted or error-free operation.

Subject to any applicable small-claims rights or other nonwaivable legal requirements, disputes relating solely to these Terms or the Dragon Phoenix website will be brought in a court of competent jurisdiction serving Buncombe County, North Carolina.
Nothing in this section prevents the parties from attempting to resolve a concern informally before litigation.
29. Severability
If a provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the extent legally permitted.
30. No Waiver
Failure to enforce a provision on one occasion does not waive the right to enforce that provision or another provision later.
31. Entire Agreement for Website Use
These Terms and the Privacy Policy constitute the general agreement governing use of the Dragon Phoenix website.
Separate agreements may govern memberships, participation, rentals, purchases, scholarships, events, or other services.
